Education (Pastoral Care of International Students) Code of Practice 2016 (the Code) – Update

Self-review and attestation 2017

Thank you to those signatories who submitted their Code attestation by the due date 31 October 2017.

NZQA is following up with those signatories that have not yet submitted their attestation. Please note that failure to carry out an annual self-review is a breach of the Code.

From December 2017, NZQA will be requesting self-review reports from a random sample of signatories. This is a part of our routine monitoring. Signatories selected will receive feedback on their self-review report early in 2018.

Support for good practice

NZQA can support Code signatories in a range of ways:

  1. Advice on interpreting and applying the Code: email code.enquiries@nzqa.govt.nz or call 0800 679 3000 and ask to speak to a member of the Code team
  2. NZQA website resources, including:
    • Overview of your basic responsibilities as a Code signatory
    • Code translations – Code and summary pamphlet (in 10 different languages)
    • Code Guidelines (schools and tertiary)
    • Factsheet on our role as Code Administrator and how we monitor performance
    • Student complaints poster (to help you meet Outcome 9 obligations)
    • Self-review report template (optional)

Coming to a region near you?

We aim to visit every major region of New Zealand at least once a year to update you on Code matters, run workshops, and answer your questions. If there is an event or meeting in your region you would like us to attend, please let us know. Depending on the timing, a representative from the Code team may be able to attend.

Helping international students get the right immigration advice

Do you have marketing managers or other staff attending education fairs around the world? Did you know that anyone providing New Zealand immigration advice anywhere in the world must be licensed with New Zealand’s Immigration Advisers Authority (IAA), or be exempt?

Anyone is exempt from the licensing requirement if they are outside New Zealand and advise on student visas only.

However, when education providers and agents are offshore they cannot advise on any other visa type including guardian visas, visitor visas, working holiday visas, work visas or residence visas.

Education provider staff or agents need to be licensed to give advice on pathways to work visas or residence visas.

So, how can education providers or agents help international students with immigration matters?

  1. You can provide publicly available information:
    • Refer or link to information on the Immigration New Zealand (INZ) webpage
    • Point out the requirements listed on a visa application form
  2. You can translate or interpret from one language to another
  3. You can work with a licensed immigration adviser
  4. You can direct students to:
  5. Ask the IAA for copies of its Guide to Licensed Immigration Advisers available in English, Chinese, Korean, Samoan, Tongan, Hindi and Punjabi.

Keeping your students safe on the roads

With the holidays coming up, NZQA encourages your organisation to discuss road safety with your students to make sure they are aware of the increased risks over the holiday period, and to keep themselves safe on the road.

Signatories to the Education (Pastoral Care of International Students) Code of Practice 2016 are obliged to ensure that international students receive as a minimum information about transport, or ways to obtain such information (section 12(c)(vi)). You and your organisation will have determined how this requirement is best met. Examples could include: information in the student handbook, material on notice boards, emails to students, and website links to additional information. Videos of road safety can also be helpful.

Lastly, while not compulsory, NZQA highly recommends you encourage your students to have at least third-party vehicle insurance if they drive a vehicle.

Providing evidence of consultation with qualification developers in programme applications

Programme developers need to contact the qualification developer when developing a programme of study.

This is because NZQA considers qualification developers to be key stakeholders in the development of programmes leading to qualifications.

Contact the qualification developer by email, which should include the following information/requests:

  • Tell the qualification developer that you are developing or have developed a programme leading to the qualification.
  • Ask whether there are any new rules, regulations, specifications or conditions since the qualification was listed on the New Zealand Qualifications Framework; or if there are any other issues to consider.
  • Seek qualification developer guidance on the proposed programme.

Qualification developers in return may request all or some of the following:

  • Industry advisory group composition
  • Programme approach (practicum/theory hours, etc)
  • Evidence that the guidance in the qualification document has been considered when developing the programme.

If there are any delays in gaining or providing this evidence from the qualification developer, please keep the NZQA evaluator informed.

These requirements are set out in the Programme Approval and Accreditation Rules 2013 (Rule 4.1).

Updated Tertiary Evaluation Indicators available

After significant sector consultation, including written feedback and workshops, NZQA has updated and refreshed the Tertiary Evaluation Indicators (TEIs).

The reviewed TEIs continue to reflect the principles of the Evaluative Quality Assurance Framework (EQAF) and form part of NZQA’s quality assurances processes. More information on the consultation, and a link to the updated indicators, can be found here.

Annual fees page updated

You can now find information on NZQA’s annual fees for all types of tertiary education organisations (TEOs) at Charges for quality assurance.

This includes:

  • The change for each type of TEO
  • Any applicable due dates for submitting forms and worksheets to NZQA
  • Information on compliance visits and when NZQA might charge for them.

Delivery sites

Clearer definitions around what constitute permanent and temporary delivery sites will be added to the NZQA website by mid-December. The Delivery Site Attestation form has been updated to reflect this.

Keeping records

A reminder that version 2 of the PTE Enrolment and Academic Records Rules 2012 came into effect in October 2016.

Rule section 6.2 of the amended Rules requires PTEs to keep all student assessments for at least 12 months from the date of completion. This means that, even if students have graduated, all of their assessment material must be retained by the PTE for at least one year.

Annual Return and Student Fee Protection audit opinions (due 30 November 2017)

PTEs with a financial year-end of 30 June 2017 were required to submit the following documents to NZQA by 30 November 2017:

Quarterly student fee protection attestation (due 14 December 2017)

The quarterly attestation form for Student Fee Protection for the quarter ending 31 August 2017 is due to your trustee by 7 December 2017. Lodge the trustee attestation with NZQA by 14 December 2017.
