Copyright on the Qualifications Authority website

The copyright on all materials contained or available on this website is subject to the copyright laws of New Zealand and copyright on all such material belongs to the Qualifications Authority. Reproduction of part or all of the contents of this website in any form is prohibited other than in accordance with the following.

You may print, recopy or temporarily store the material on this website for your own personal information and use, or for the personal information and use of other individual third parties. Any copyright notice on the material must be retained on the copy. In addition, you must expressly acknowledge the Qualifications Authority website as the source of the material and include the Qualifications Authority web address (http://www.nzqa.govt.nz) in the copy of the material. You must also inform any third party that these conditions of use apply to them.

Use of National Qualifications Framework (NQF) material

The Qualifications Authority provides access to a variety of NQF materials. These include, but are not limited to:

  • unit standards
  • achievement standards
  • national qualification documents
  • NQF assessment materials
  • National Certificate of Educational Achievement exam material.

These materials are copyright to the Qualifications Authority and are protected by New Zealand copyright laws and international treaty obligations. A number of these resources have been developed by third parties, however copyright in all instances resides with the Qualifications Authority.

New Zealand NQF accredited organisations may download and copy these resources for use by their organisations as per the following procedures:

  • Copies must be used only for the organisation's internal purposes by its staff and learners (for example, assessing learners, preparing programmes of activities, as reference materials for teachers, etc).
  • All materials and documents, including any part thereof, must always carry the Qualifications Authority Copyright Notice, as appears at the bottom of each page.
  • Copies must not be rented out, sold or lent, whether for payment or not. Copies must not be given out, or used by organisations other than the NQF accredited institution, although learners may retain any copies given to them as handouts for activities or assessments.

Non-NQF accredited organisations must seek specific copyright clearance from the Qualifications Authority before using these NQF documents. Non-accredited organisations will be given copyright clearance to use these documents at no charge provided they are not for commercial purposes and they undertake to inform learners that completing these programmes using these NQF materials will not entitle them to formal recognition against NQF standards or the award of an NQF qualification. Please contact the Approvals, Accreditation and Audit business unit to gain this clearance.

Commercial applicants wishing to use Qualifications Authority copyrighted material in their publications.

The Qualifications Authority may consent to a commercial applicant using Qualifications Authority copyright material in their publications. In making a decision the Qualifications Authority may consult relevant stakeholders and identify an appropriate fee. The fee for each use will reflect the costs incurred by the Qualifications Authority in preparing these documents.

Application process for National Certificate of Educational Achievement and Scholarship Exam Papers

Potential applicants should identify the standards and levels of the papers they wish to use, and contact the Assessment section of the Authority. Alternatively, application forms are available on the Authority's website. Forms should be completed and returned together with material, which shows how the papers, in whole or part, will be used.

Conditions

Written acknowledgement must be given to the Authority at the beginning of the publication. The acknowledgement must state that the New Zealand Qualifications Authority owns the copyright of the paper or questions reproduced and has consented to the reproduction of that paper of questions. In addition, the authors/publishers must clearly distinguish material developed by the Authority from material produced by or for the authors/publishers.

Part 2, Section 49 of the Copyright Act 1994 allows the Qualifications Authority to waive the copyright of third parties to produce national examination papers. National Certificate of Educational Achievement and Scholarship examination questions may, therefore, use material for which the copyright is held by a third party and it is the publisher's responsibility to apply for copyright use to the third party.

Use of NQF material by overseas educational organisations

Any international educational institution wishing to use NQF material must contact the Policy, Research and International team to discuss this.

Reproduction of the Qualifications Authority logo

The New Zealand Qualifications Authority logo is the key element of The Qualifications Authority's corporate visual identity. The Qualifications Authority has strict guidelines about the reproduction and use of the logo.

National Certificates

Organisations that have been granted permission by the Qualifications Authority to issue National Certificates or National Diplomas may use the Qualifications Authority logo on those certificates. For more information contact the Tertiary Records team.

Government agencies

Government agencies may use the Qualifications Authority logo only if the Qualifications Authority has granted approval in writing. If the Qualifications Authority has agreed to the use of its logo, a member of the Qualifications Authority Communications team will supply the logo, which must not be altered in any way. For more information contact Communications and External Relations.

Other circumstances

The Qualifications Authority logo may not be used in any other circumstances, including advertising or publicity materials, corporate documents or web pages.

Qualifications Authority registration and accreditation (of private education providers, for example) does not entitle an organisation to use the Qualifications Authority logo in any context.

A registered private training establishment may make the following statement on certificates, in publications and in publicity material:

Registered as a private training establishment by the New Zealand Qualifications Authority under the provisions of the Education Act 1989 and its subsequent amendments.
