Compliance Notices issued to PTEs
Update 9 August 2010: NZQA has cancelled the registration of three private training organisations for failing to comply with their Compliance Notice. See announcement below.
NZQA has issued Compliance Notices to 42 PTEs for failing to submit the necessary documents for their Annual Return, as required by their registration criteria.
As part of quality assurance, all PTEs are required to provide a Statutory Declaration (of compliance) and a Chartered Accountant Professional Attestation, which make up the Annual Return. These Compliance Notices were issued on 13-14 July, 2010, for failing to provide one or both of these requirements. PTEs have 10 working days to comply.
All PTEs with a 31 March 2010 financial year-end were required to provide the Annual Return by 30 June 2010.
Publication of summary of Compliance Notices issued by NZQA to registered Private Training Establishments
Pursuant to section 255A(4) of the Education Act 1989, the New Zealand Qualifications Authority publishes the below summaries of Compliance Notices issued to registered private training establishments ("registered PTEs") for failure to submit both or one of the required documents that make up the Annual Return.
The required Annual Return consists of the following two documents: Statutory Declaration (DOC, 138KB)(of compliance), and Chartered Accountant Professional Attestation (PDF, 31KB).
The following lists contain the names of PTEs that, as at 3:45pm on 6 August 2010, have yet to comply following the issuing of Compliance Notices. NZQA will update this list regularly to reflect the current position.
Category 2
A compliance notice has been issued to each of the following registered PTEs for not providing the required Statutory Declaration:
- Thinking Safer
Should any of the registered PTEs in Category 1 or Category 2 not comply with the Compliance Notice within 10 working days of the Notice, NZQA has given notice that it will use its option to cancel the PTE's registration.
Should any of the registered PTEs in Category 3 above not comply with the Compliance Notice within 10 working days of the Notice, NZQA has given notice that it will use its option to either cancel the PTE's registration or impose conditions on its registration.
9 August 2010: Compliance Notice closures
NZQA has cancelled the registration of three private training establishments (PTEs) for failing to comply with a Compliance Notice issued under S255A of the Education Act 1989.
All PTEs with a 31 March 2010 financial year-end were required to provide an Annual Return by 30 June 2010. Failure to provide Annual Return documents saw 42 PTEs issued with Compliance Notices. Of these, three PTEs had their registration cancelled. The three PTEs are:
- @lpha Consultant (2002) Limited
- ParaMed Limited
- Education 2create Limited.
These PTEs failed to submit the necessary documentation which constitutes the Annual Return within the timeframe specified by the Compliance Notice issued to them. The Annual Return is made up of both a Statutory Declaration (of compliance) and a Chartered Accountant Professional Attestation.
"The new quality assurance system is based on a high-trust and high-accountability approach, said New Zealand Qualifications Authority Deputy Chief Executive, Quality Assurance, Tim Fowler.
“Where PTEs are not complying with registration criteria, they will be held accountable. NZQA is pleased the vast majority of PTEs have now complied and this shows the system is working.
“We know that most PTEs comply and the PTE sector organisations agree with this action."
