NZQA statutory actions May 2016 – June 2017

NZQA ensures that non-university tertiary education organisations (TEOs) comply with quality assurance requirements. We operate an integrated quality assurance system in which all the components support each other.

Our quality assurance system includes qualification approvals and programme approvals processes, accreditation to deliver, consent to assess and training scheme approvals, ITO quality assurance, Code signatory status, risk management of complaints and issues of non-compliance, and the External Evaluation and Review process. Together these form a strong quality assurance platform.

NZQA is able to take statutory action in accordance with the provisions of:

  • the Education Act 1989 (the Act)
  • NZQA Rules (made under section 253 of the Act) (the Rules)
  • and the Education (Pastoral Care of International Students) Code of Practice 2016 (the Code).

When a non-university TEO or a Code signatory is not compliant with the Act, NZQA Rules and/or the Code, NZQA is empowered to use a range of statutory actions, where relevant and applicable, including:

  • Issue compliance notices to direct the organisation to do (or refrain from doing) something specific (e.g. ensure that the organisation’s student files are accurate and complete by a given date).
  • Impose conditions to specify constraints that the organisation will be subject to (e.g. submit extra assessment materials for moderation and demonstrate improved moderation results, or stop enrolment of new students).
  • Withdraw consent to assess against standards or accreditation to deliver a programme.
  • Remove the Code signatory status, so that the Code signatory cannot enrol new international students, or continue to have any existing international students enrolled.
  • Cancel the registration of a private training establishment (PTE).

New Zealand has a strong reputation for delivering quality education, protecting the interests of New Zealand and international students. It is important we have a high performing tertiary education sector that provides excellent outcomes.

NZQA has received several official information requests for historical statutory actions that we have undertaken in the tertiary sector. That information is now presented below, in a list of statutory actions taken in relation to NZQA rules for the period May 2016 until June 2017. From 1 July 2017 NZQA has published new statutory actions here on the NZQA website.

It should be noted that each of the actions below may only apply to certain programmes or standards offered by the provider, rather than the all the programmes they are accredited by NZQA to deliver, or standards they have consent to assess against.
